These Terms of Service ("Terms") are an agreement between you and HoodNerdz Technology ("HoodNerdz", "we", "us"), 6071 Old National Hwy Unit A #110, Atlanta, GA 30349. They apply when you create an account, buy anything from hoodnerdztechnology.com, or use our affiliate or developer programs. If you don't agree, please don't use the site.
1. Your account
- You must be at least 18 and able to enter a contract. Give us accurate details and keep them up to date, including your domain owner address.
- You're responsible for everything done with your login. Keep your password private and tell us right away if you think someone else has used it.
- For security, you're signed out after 3 hours without activity.
2. Prices, fees and taxes
- Prices are shown on the site in US dollars and can change. Changes apply to new orders and to the next bill after the change.
- Every order and every bill includes a $1.00 platform fee and a card processing fee of 3.3% + $0.30. Sales tax is added where it applies.
- Merch orders include the shipping cost shown at checkout.
3. Automatic payments
When you pay for hosting or a domain, you allow us to save that card with our payment processor, Stripe, and charge it without asking each time for:
- your monthly hosting bill on the 1st of each month;
- domain renewals, a few days before each domain expires (domains renew for one year at the price at the time);
- a declined payment, which we may retry every 3 days.
You can turn auto-pay off, or turn off auto-renew for any domain, in your account at any time. With auto-pay off, bills wait for you to pay them. We never see or store your full card number.
4. Web hosting
Deposit
When you buy a hosting plan you pay a deposit of about one month's price. The deposit isn't used for your first month: it's held and pays your final bill when the plan ends (like last month's rent). If you change plans, the old plan's deposit is credited against what you owe on it.
Billing by the hour
Hosting is charged by the hour. On the 1st of each month you're billed for the hours you had the plan the month before, plus a $2 service fee per plan. A full month comes to about the plan's monthly price; months with more or fewer days cost a little more or less.
Unpaid bills
If a bill isn't paid within 7 days, your hosting is suspended. If it's still unpaid at the next month's billing, you'll get a final warning, and the month after that your hosting is removed, including its files, databases and mailboxes.
Cancelling
Turn renewal off and the plan ends at the next billing date. Your final bill covers the hours used, minus your deposit.
5. Domains
- Domains are registered through our registrar partner, Openprovider, in your name, so you are the legal owner. Registrations are also subject to the rules of ICANN and of each domain extension's registry.
- We turn on WHOIS privacy where the extension allows it, so your address isn't shown in public lookups. Some registries require public details; we can't control that.
- You must give a real owner name and address. False details can lead the registry to suspend or cancel a domain.
- We send renewal reminders 30, 15 and 5 days before a domain expires. If a domain expires, any hosting on it is paused, you're warned after 15 days, and the hosting is removed after 30 days. Restoring a domain after that can carry extra fees from the registry.
- Transfers in can be declined by the current registrar (for example a wrong transfer code or a locked domain). Declined transfers are refunded automatically.
- You can get your domain's transfer code from your account at any time, unless the domain is within a registry lock period.
6. Website builds
- A website build package includes what its page lists, including a set number of revision rounds. Work starts when you complete the project survey.
- A HoodNerdz developer builds the site on your hosting and sends it to you for review. The project is complete when you approve it.
- You must have the rights to anything you give us to use (logos, photos, text). You own the finished site's content; hosting for it is billed as above.
7. Merch
Merch is printed to order by our print partner and shipped to the address you give. Delivery times are estimates. See the Refund Policy for damaged or wrong items.
8. Offers and affiliate codes
- Free .com with hosting: with a valid affiliate code, an order with a hosting plan and the new registration of a .com for it gets the .com free for its first year. Each customer can get this 3 times.
- Limited offers (like a free .com with a hoodie) run only while shown on the site and may end at any time.
- Free domains are free for the first year only. They renew at the normal price, automatically if auto-renew is on.
- One free .com per order. Offers can't be exchanged for cash. You can't use your own affiliate code. We may cancel offers used against these rules.
9. Affiliate program
- Affiliates earn commission on hosting paid by customers they refer (for as long as the customer stays) and a set amount per merch item ordered with their code. A referred customer's orders use their affiliate's code automatically unless they remove it or enter another. Current rates are shown in the Affiliate Hub and can change; changes apply to new sales.
- Commission is paid on the 1st of each month once it's at least 3 days old, to a payout account set up through Stripe. Commission on payments that are refunded or disputed is cancelled.
- No self-referrals, spam, misleading ads, or bidding on our brand name. We may withhold commission earned against these rules and close the account.
- Affiliates are independent, not employees or agents of HoodNerdz, and are responsible for their own taxes.
10. Developers
Approved developers are paid each project's payout once the client approves the finished site, on the 1st of the following month, to a payout account set up through Stripe. Developers are independent contractors, responsible for their own taxes, and must keep client information confidential.
11. Acceptable use
Don't use our services for anything illegal or harmful, including: spam or bulk unsolicited email; malware, phishing or fraud; content that infringes others' rights; sexual content involving minors; harassment or threats; attacking or overloading other systems; or reselling our services without permission. We may suspend services that break these rules, immediately if needed to protect others, and we cooperate with valid legal requests.
12. Your content and backups
You own what you put on your sites and mailboxes, and you're responsible for it. We back up our systems, but those backups are for our recovery, not yours. Keep your own copies of anything important.
13. Warranties and liability
We work hard to keep everything running, but services are provided "as is", without guarantees of uninterrupted or error-free operation. To the extent the law allows, HoodNerdz isn't liable for indirect or consequential losses (such as lost profits or data), and our total liability for any claim is limited to what you paid us in the 12 months before it. You agree to cover our costs from claims caused by your content or your breach of these Terms.
14. Ending service
You can close your account by turning off renewals and contacting us. We may suspend or end services for unpaid bills, for breaking these Terms, or when required by law. Domains you own stay yours: you can transfer them to another registrar.
15. Changes and contact
We may update these Terms. We'll post the new version here with its date, and for significant changes we'll also email you. These Terms are governed by the laws of the State of Georgia, USA. Questions: hoodnerdzllc@gmail.com or our contact page.
